Terms and Conditions
These terms are an agreement between you and AI2 Marketing (“AI2”, “we”, “us”) for the website at ai2.marketing and for the Comigo app for Mac. If you download Comigo from the Mac App Store, the Apple terms in the section below also apply. By using the site or the app, you agree to these terms and to the Privacy Policy.
If you are using AI2 for a client project (software, marketing, automation or creative work), the signed proposal or statement of work controls that project. These terms still cover the website and Comigo.
License to use Comigo
AI2 grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Comigo on Apple-branded computers that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms. You do not buy the software itself. We keep all rights that are not expressly granted.
You may not copy the app except as needed to use it, rent it, sell it, reverse engineer it except where the law forbids that limit, or use it to build a competing product. You may not remove notices in the app.
Mac App Store
If you got Comigo from the Mac App Store, you and AI2 acknowledge that:
- These terms are between you and AI2 only, not with Apple. AI2, not Apple, is responsible for Comigo and its content.
- The license is limited to a non-transferable license to use Comigo on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
- AI2 is solely responsible for maintenance and support. Apple has no obligation to furnish maintenance or support for Comigo.
- If Comigo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost or expense from a failure to conform to a warranty is AI2’s responsibility.
- AI2, not Apple, is responsible for addressing claims by you or a third party relating to Comigo or your use of it, including product liability claims, claims that the app fails to conform to a legal requirement, and consumer-protection claims.
- AI2, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that Comigo or your possession and use of it infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with third-party terms when you use Comigo, including your AI provider’s terms if you connect your own API key.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

Accounts, credits and your own keys
Comigo can run with your own API key or a local model, or with Comigo credits. You are responsible for the activity on your account and for keeping your sign-in and API keys private. Credits, when you buy them, are a prepaid balance for AI usage. They are not cash, have no cash value, and are not transferable. Card payments are processed by Stripe. If Apple charges you for a purchase made through the App Store, Apple’s payment and refund rules apply to that purchase.
Acceptable use
You will not use the site or Comigo to break the law, to infringe someone else’s rights, to send malware, to attack our systems or another person’s systems, or to submit someone else’s personal information without the right to do so. You are responsible for what Comigo is allowed to see on your screen, including other people’s information that appears there.
Comigo advises. You decide. Its suggestions are generated by software and can be wrong. They are not legal, medical, financial, tax or other professional advice, and they are not a promise of a particular business result.
Your content
You keep ownership of the content on your Mac, including screens, transcripts, tasks and memories. When you use Comigo credits, you give AI2 a limited license to process the prompt and related context on our server only to provide the feature, bill for it, prevent abuse and support you, as described in the Privacy Policy. When you use your own key or a local model, that processing does not go through AI2.
Client work
Quotes on the website are invitations to talk, not a fixed offer. Work starts when both sides agree in writing. Unless that writing says otherwise, you own the deliverables we create for you once they are paid for, and we keep our pre-existing tools, templates and know-how. We may mention the engagement in our portfolio unless you ask us not to.
Warranties and liability
The website and Comigo are provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, that advice will be accurate, or that a local or third-party model will be available.
To the fullest extent allowed by law, AI2 is not liable for indirect, incidental, special, consequential or lost-profit damages, or for loss of data stored on your Mac. Our total liability for a claim relating to the website or Comigo will not exceed the amount you paid AI2 for Comigo credits in the three months before the claim, or fifty U.S. dollars if you paid nothing. These limits do not apply where the law does not allow them, including liability for fraud or for death or personal injury caused by negligence.
Ending use
You may stop using Comigo and delete it at any time. We may suspend an account or the credit service if you break these terms, if a payment fails, or if we need to protect the service or other people. Sections that should survive (including ownership, warranties, liability and the Apple third-party beneficiary terms) keep applying.
Law
These terms are governed by the laws of the State of Florida, USA, excluding conflict-of-law rules. Courts in Florida have exclusive jurisdiction, except that Apple may enforce its third-party beneficiary rights where it is allowed to, and except where the law where you live requires a different forum for consumers.
Changes
We may update these terms by posting a new version on this page with a new effective date. If you keep using the site or Comigo after that date, the new terms apply. If you do not agree, stop using the app and delete it.
